These terms form the agreement between SoftBela and the business that opens an account. By creating a workspace, inviting users or paying a subscription you confirm you are authorised to accept them on behalf of your business.
1. Definitions
"Service" means the SoftBela platform, including the workspace, the public booking page, the marketplace listing and the marketing site. "Organisation" is your business account. "Users" are the people you invite. "Client data" is the information about your clients that you enter or that they submit when booking.
2. Accounts and eligibility
You must be a legally registered business or a self-employed professional, provide accurate business information and keep it current.
- You are responsible for everything your users do with their credentials.
- Passwords must not be shared; each person who needs access gets their own user.
- We may refuse or close accounts created with false information or used to impersonate another business.
3. Trial and subscription
New organisations start on a free trial with the plan features available. After the trial the subscription is billed in advance, per business, in the currency shown at checkout. Detailed billing rules are set out in the Subscription Terms, and refunds in the Refund Policy.
4. Booking deposits and service fee
If you enable online deposits, your salon chooses the percentage clients pay when booking (for example 30%, 60% or 100%), and the remainder is settled at the salon. A 6% service fee covering payment gateway costs is added to the amount the client pays online, so the salon receives its price in full. SoftBela is not a party to the service contract between your salon and your client, and does not act as a payment institution.
5. Your data and ours
You keep all rights to your business and client data. You grant us only the licence needed to host, process, back up and display it so the Service works, and to provide support when you ask. We keep ownership of the software, brand and documentation. You may export your data at any time while the account is active.
6. Your responsibilities
You are responsible for lawful use of the Service in your country.
- Invoicing, tax rates and fiscal obligations applicable to your business.
- A lawful basis for storing client records and for sending reminders or marketing.
- Accuracy of prices, opening hours and availability published on your booking page and marketplace listing.
- Employment and commission arrangements with your staff.
7. Availability and support
We aim for 99.5% monthly availability, excluding announced maintenance and events beyond our control. Planned maintenance is scheduled outside peak salon hours where practical and announced in advance. Support is provided by email and WhatsApp in English, Portuguese, French and Spanish during business hours.
8. Suspension and termination
You may cancel at any time from the workspace; access continues to the end of the paid period. We may suspend an account for non-payment after notice, for a breach of the Acceptable Use Policy, or where continued use threatens the security of other businesses. Serious abuse may lead to immediate suspension. After termination you have 30 days to export your data.
9. Warranties and liability
The Service is provided with reasonable skill and care, but not as error-free. To the extent permitted by law, SoftBela is not liable for indirect or consequential loss, lost profit or lost data caused by factors outside our control, and our total liability in any 12-month period is limited to the subscription fees you paid in that period. Nothing in these terms excludes liability that cannot lawfully be excluded.
10. Changes, governing law and disputes
We may update these terms; material changes are announced at least 30 days in advance and continued use after that date constitutes acceptance. The agreement is governed by the laws of the Republic of South Africa, where SoftBela is established, without affecting mandatory consumer protections in your own country.
